01 / provider and scope
these terms govern services supplied by Jesse Keating trading as FRAME by Jesse, based in Kildare, Ireland.
FRAME by Jesse provides online coaching, private coaching, training programmes, educational content and related fitness services. the exact service, price, billing period and inclusions are shown before purchase or confirmed in writing.
02 / eligibility
coaching services are available only to people aged 18 years or older.
by applying for or purchasing coaching, you confirm that you are at least 18 and legally able to enter this agreement.
03 / nature of coaching
coaching provides fitness, training, nutrition and lifestyle guidance for educational purposes. it is not medical diagnosis, treatment, physiotherapy or dietetic care.
you should obtain advice from an appropriately qualified healthcare professional before beginning a programme where your health, symptoms, medication, injury or circumstances make that appropriate.
04 / Everfit and digital delivery
online coaching may be delivered through Everfit or another service identified before use. FRAME designs and manages the coaching. Everfit supplies the software platform and has its own terms and privacy information.
you are responsible for maintaining compatible access, protecting your login details and notifying FRAME promptly if you believe your account is being used without permission.

safe and effective coaching depends on accurate information and timely communication.
provide complete and accurate information
disclose relevant injuries, symptoms, health conditions, medication and physical limitations
stop an exercise and seek appropriate help if you feel unwell or unsafe
use equipment and facilities responsibly
follow professional medical advice where it applies
communicate changes that may affect the programme
06 / health information and consent
measurements, progress photographs, nutrition records, exercise videos and health information are collected only where relevant to the coaching and are identified as required or optional at the point of collection.
where processing health information relies on explicit consent, you may withdraw that consent at any time. withdrawal does not affect earlier lawful processing, but it may limit the coaching FRAME can safely provide.
privacy choices and health data consent are separate from consent to marketing.
07 / payments and receipts
the total price, currency, billing schedule and any recurring charge are shown before purchase. payment is due through the payment method presented at checkout.
if payment fails, FRAME may pause future service after giving reasonable notice. completed work and statutory rights remain unaffected.
08 / monthly coaching
a monthly coaching plan renews at the price and interval disclosed at purchase until you cancel it.
you may cancel before the next billing date by emailing hello@framebyjesse.com. cancellation takes effect at the end of the current paid period unless the confirmation says otherwise. FRAME will confirm the cancellation in writing and will not charge later billing periods.
a future price change will be communicated in writing at least thirty days before it applies. you may cancel before the new price takes effect.
09 / online withdrawal right
where Irish or European Union consumer law applies, a consumer who enters a service contract online generally has fourteen days from the date the contract is agreed to withdraw without giving a reason.
to exercise this right, send a clear statement to hello@framebyjesse.com before the period expires. include your name, email address, service purchased, order date and a statement that you wish to withdraw.
if you expressly ask FRAME to begin during the withdrawal period, FRAME may charge a proportionate amount for service supplied before withdrawal. if the service is fully supplied during that period after your express request and acknowledgment, the withdrawal right may end as permitted by law.
10 / refunds
refunds are assessed according to the service delivered, the withdrawal rights above and applicable consumer law. nothing in these terms removes a refund, repair, repeat performance, price reduction or other remedy that the law provides.
a digital programme or digital content will not be treated as automatically non refundable. any loss of a statutory withdrawal right requires the consent and acknowledgment required by law.
11 / private session changes
the notice period for rescheduling or cancelling a private session is shown before booking or in your written confirmation.
FRAME will apply only the fee or forfeiture disclosed for that booking and will consider emergencies and circumstances outside reasonable control fairly. if FRAME cancels, the session will be rearranged or refunded.
12 / service standard
FRAME will provide the service with reasonable care and skill and in accordance with the description agreed at purchase.
if a service does not conform to that agreement, contact FRAME promptly so the issue can be assessed and an appropriate legal remedy provided.
13 / results
results vary with adherence, training history, genetics, nutrition, recovery, sleep, stress, health and other individual circumstances.
FRAME does not guarantee a particular change in weight, measurements, appearance, strength, performance or body composition.
14 / communication and response
coaching is not continuously monitored and is not an emergency service. review and response frequency depends on the coaching experience selected and the availability described at purchase.
if you need urgent medical assistance, contact the appropriate emergency service or healthcare professional.
15 / fair suspension or termination
either party may end coaching in accordance with the cancellation terms. FRAME may suspend or end future service for serious safety concerns, unlawful conduct, abuse, persistent non payment or material breach after reasonable notice where appropriate.
any refund or outstanding payment will be calculated fairly by reference to service already supplied and applicable law.
16 / intellectual property
training programmes, written guidance, videos, templates, branding and original materials supplied by FRAME remain protected intellectual property.
you receive a personal, limited right to use purchased materials for your own coaching. you may not resell, publish, share or commercially reproduce them without written permission.
17 / privacy
personal information is handled according to the FRAME privacy policy. Everfit and other named providers process information only for the purposes described there and under their applicable terms.
18 / responsibility and liability
FRAME is responsible for loss that is a foreseeable result of a failure to use reasonable care and skill or a breach of this agreement.
FRAME is not responsible for loss caused by inaccurate information you supplied, instructions you ignored, unsafe facilities or events outside reasonable control, except where the law provides otherwise.
nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, deliberate misconduct, or any right or liability that cannot lawfully be excluded.
19 / changes to terms
the terms in force when you purchase a service apply to that purchase. FRAME may update terms for future purchases and may change an ongoing service only where the contract and law permit.
a material change to an ongoing paid service will be communicated in advance with a clear explanation and any right to cancel.
20 / complaints and governing law
please raise a concern with FRAME first so it can be reviewed promptly and fairly.
these terms are governed by the laws of Ireland. if you are a consumer in another country, mandatory rights and the courts available to you under applicable consumer law remain unaffected.
